My host is busy copying across all the files from cgi-bin, but the contents of data directory need refreshing with the latest information shortly before switching the new server live.

Once GMail is set up and working on the new server, can I just delete "data" and replace it with the contents of the latest data dir? What about data.bak? Should I delete this too and if so would GMail automatically create a new daka.bak folder?

You need to update/sync up the data directory as well as the database. Gossamer Mail doesn't create a data.bak, so that's probably a backup you made yourself before.
