UK jails schizophrenic for refusal to decrypt files

The first person jailed under draconian UK police powers that
Ministers said were vital to battle terrorism and serious crime has
been identified by The Register as a schizophrenic science hobbyist
with no previous criminal record.

His crime was a persistent refusal to give counter-terrorism police
the keys to decrypt his computer files.

Re: UK jails schizophrenic for refusal to decrypt files [In reply to]

To me, the Brits - sorry, their government - are more and more turning
into fascists.

What, if somebody has 'really' forgotten his password or lost his key?
Jail for amnesia?

besides, everybody has the right to refuse to answer - meaning the
freedom of his / her mind.

Today, a computer often has become a part of the mind - notes, diaries
and so on. Therefore, this case to me is somehow equivalent to putting
someone into jail just because he does not want to answer a question -
which is definatelay a violation of a fundamental human right.

However, I believe that this happen more often will be the future - at
least in Europe and not only in the UK.

Maybe ppl should vote from the rooftops...

Cheers

Gregor

Indeed, I seem to recall that in the decision of the German high court (the country where bureacrats are maybe the most advanced in understanding technology) there was a reasoning to that effect, e.g. arguing that the contents of computers fall under the freedom of thought, since you use them to put down your everyday thoughts. I could be mistaken about the fact though, but the line of thought is really interesting: to recognise in the legal system the fact that in practice we became cyborgs: our neural circuits are interrupted and wired to our notebooks. Not a new thing, that one about using notebooks, of course (that changed happened a long time ago), but still widely unrecognised. 8-/

What exactly do you expect the Brits to "vote from the rooftops" with?
They can't even legally own pointy pieces of metal. Do you expect
them to throw chip buttys and pints of ale down at the police state
thugs holding automated rifles?

This is a defacto ban on civilian use of encryption technology, that's
all it was ever intended to be. After all, who wants to spend several
years in prison for forgetting a password? This falls under the
mentality of, "if you have nothing to hide then you have nothing to
fear."

Britain is a lost nation from the human rights perspective. Luckily,
their problems are not our problems, yet.

First, I'm neither British nor based in the UK, despite my Email
address and this is not a defense of the UK position, which sucks.

You say "our" -- you mean the USA??

If so, then you are really behind on your reading. The US has almost
exactly the same laws in place thanks to some of the weasel words in
the Patriot Act and its friends.

I'm continually surprised how ignorant of this so many US folk are.

Regards,

Nick FitzGerald
